In 2006, nearly 600 motorists died from alcohol related accidents. The people of Arizona wanted tougher DUI laws, after months of lobbying their state legislators, they got what they asked for: Super Extreme DUI. Arizona’s Super Extreme DUI law lives up to its namesake. The new Super Extreme DUI law was designed to send a clear message to drunk drivers in the state. If you are convicted of a Super Extreme DUI expect your life to turn upside down, and inside out, for years to come.
A Super Extreme DUI is a misdemeanor, however the penalties associated with it are harsher than some felonies. Drivers caught with a blood alcohol level of .20 or higher will be arrested and prosecuted under the new Super Extreme DUI laws.
The difference between a DUI and a Super Extreme DUI are the penalties. If convicted of a Super Extreme DUI plan on losing your driving privileges for up to 3 months. You will spend a minimum of 45 consecutive days in jail, however if you were to receive the maximum jail time, you could spend six months in county clothing. State legislators thought it would be prudent for you to pay your way while in jail so they will charge you between $70 and $100 for each day you are incarcerated.
You could receive up to five years probation along with fines topping out near $3,000. Finally you will be required to purchase and install an Ignition Interlock Device in your vehicle. The device is much more than a nuisance. It is a proactive breathalyzer apparatus that locks your ignition if it senses any alcohol on your breath. Each time you get behind the wheel of your car, you will need to prove you are sober before the device will allow you to start your vehicle. Furthermore, the Ignition Interlock Device must remain installed in your car for 18 months (after your license has been reinstated).
Arizona’s DUI laws are some of the toughest in the nation. The days of casual drinking and driving home are a thing of the past. The penalties which are severe by any measure, do not take into consideration hiring an attorney to assist you, increased insurance premiums, and the many social stigmas that come with a conviction of this nature. Many attorney’s throughout the state are specially trained and educated to defend those who find themselves at the mercy of Arizona’s Super Extreme DUI law. Attorney’s fees vary however you could expect to pay several thousand on up to retain a qualified defense team.
The new Super Extreme DUI law is not without its critics. There are several court cases that are challenging the legality of the new laws. Getting convicted of any DUI is miserable enough but a Super Extreme DUI is by all measures, horrible in all respects. The jail time, the fines, and the stigma that comes along with a conviction of this sort will affect you in many ancillary ways. Imagine if you are a sales executive and you have to drive clients around in your car . . . the Ignition Interlock Device now becomes your worst nightmare. Several states have enacted similar laws to Arizona’s in the hopes of reducing their states alcohol-related fatalities.
Drinking and driving is never worth the risk. The new Super Extreme DUI law makes drinking and driving on the same level as some felonies, and that was the state legislatures intent. Maybe now those who drink and think its normal to get behind the wheel of an automobile will reconsider. A conviction of this nature affects not just the drunk driver but all of us.
