If a juvenile commits a DUI, the charge will be processed through the juvenile criminal system. In some cases the DUI may be charged in the adult criminal system, but could be charged as an underage drinking while driving offense. In the local criminal law circles, this is referred to as a “baby DUI”.
Underage drinking and driving has different consequences from a regular adult DUI. The main difference is if you are convicted of underage DUI, there is no mandatory minimum jail sentence associated with it. However, there is a mandatory two-year suspension of driving privileges with the Arizona Motor Vehicle Department (MVD), if convicted of an underage DUI.
